IN DEFENSE OF FAIRNESS AND LIFE: DEMOCRATS REJECT GOP DEATH PENALTY BILL

The Senate Democratic Caucus strongly opposes Republican-led legislation to reinstitute the death penalty in San Andreas. If the “State Defense and Deterrence of Terrorism Act” is passed, San Andreas would become the first state in the union to reimpose the death penalty after its repeal. This sets a dangerous precedent for other states.

 

Proponents of capital punishment argue that the death penalty would serve as a necessary deterrent. However, this is factually incorrect. Statistics show that states with the death penalty have higher rates of crime than states without the death penalty. Moreover, there is no evidence that suggests the number of murders per capita rose after the death penalty was abolished in San Andreas. Instead, reinstituting the death penalty will contribute to legal, financial, and administrative burdens on an already resource-strained justice system. Evidence shows that the death penalty is even more expensive than life in prison due to the extensive appeals process.

 

Republicans affirm that the death penalty is a “silver bullet” to deal with crime in our state. This notion is not supported by evidence. Instead, more resources should be invested in prosecuting and dismantling criminal organizations that contribute most to the crime rate in our state. Moreover, more must be done to address the root causes of crime in society. Policies include investing in early intervention, educational opportunities, supporting a fair wage, union bargaining rights, and addressing disparities and inequities in our society.

 

Senate Democrats have already taken steps to strengthen law enforcement and deterrence. Senators Jones has introduced the Department of Corrections and Rehabilitation Authorization Act to establish a fair, humane, and comprehensive corrections system. The law will ensure that those who violate the law are held accountable for their crimes. Moreover, by rehabilitating criminals through an effective parole system, the Department can help break the cycle of crime that plagues our communities.

 

While the caucus sympathizes with victims of capital crimes and their desires for justice, we believe that capital punishment is not the solution. We cannot risk the possibility of an innocent person being executed, since there is no way to reverse that sentence. The justice system is not perfect. Innocent people have fallen through the cracks and have been wrongfully convicted of murder. Even today, with advances in DNA technology, individuals are wrongly convicted. The justice system is not (and never will be) perfect, and no reasonable person should claim that it is. The most permanent and ultimate punishment requires unrealistic expectations in the justice system.

 

The Democratic Caucus will work tirelessly to build for ourselves and future generations a more equitable society and stronger justice system without resorting to disproven medieval forms of punishment.

Comment: I am happy to see that Democrats are playing the role of the grown-ups in the room, as this should not even be a debate that a civilized society is having. Republicans need to stop using the specter of taking human lives to sell this narrative of a "silver bullet" on crime. There is no "silver bullet" solution, and it is dishonest and frankly sickening to hear such barbaric things spoken by elected leaders. The solutions are complex just like the problems. More community policing, more direct collaboration between the public and law enforcement/government, and more accountability for those in power. Killing is not the answer, and it will not undo the harm that criminals do, nor deter them.
