  1. "Counselor I am going to ask you to contain yourself. This is the appeal of an infraction this would never be in front of a jury. It is your right to appeal this to the Supreme Court, and If the higher court requests me to expound on my Judgement I will and not before. Due process violations for a State level infraction you were only fined for and had a day in court for is unmerited. With that being said this court is adjourned."

    APPELLATE COURT JUDGEMENT

     

    After thorough review of the case, the Appellate Court has come to a verdict on the allegations and is thus ready to deliver a ruling in accordance with all applicable federal, state, and local law and/or ordinance to ensure fair and just enforcement of the law within the boundaries of the state. It is of the official opinion of the court that;

    • On March 3rd the Appellant opened their restaurant the "Up N' Atom" for business in a first time grand opening. Shortly after opening deputies from the San Andreas Department of Forestry and Fire Protection (SANFIRE) entered the business and performed an inspection of the business. During this inspection the deputies identified what they believed was a violation of the San Andreas Fire code in the form of an Ashtray with a lit cigarette. The appellant filed for a hearing on this petition in the lower court where they sided with SANFIRE on their issuance of the fine. The argument made by the appellant was that the ashtray served simply as a prop to facility decorate of their establishment. It is this court's view that since the ashtray contained a lit cigarette it cannot be viewed simply as a prop. Since the ashtray contained what the Fire Code would define as "smoking paraphernalia", since it was being used to contain the ash of what appeared to be an at once lit cigarette. The existence of paraphernalia in the appellant's place of business can defined as "smoking" in accordance with Chapter 5 Section 1. of the Fire code. Therefor this court will be upholding the lower court's decision. This court also finds no merits to the claims of due process violations made by the appellant. 

    And thus in support of the narrative, it is the finding of the court that in the case matter at hand, the court rules; 

     

     

    That the lower courts decision shall be upheld and affirmed for reasons of;  

    • This court found no merit to the alleged due process violations.
    • An ashtray with a lit cigarette meets the definition of "paraphernalia" in the San Andreas Fire Code

     

    I declare under penalty of perjury under the laws of the State of San Andreas that the foregoing is true and correct.

  3. The rules are partly to blame. The rules are written in a way that mandate admin involvement oppose to player led solutions. I've been on servers that encourage player led resolutions to conflicts and find they have a much better culture around these things. Take things like car accidents. If everyone involves agrees to void them why not allow that to happen without admin involvement? Admins will complain about being overwork but leaderships writes rules that requirement admin involvement into everything on a server so large. I've seen companies publicly traded on the stock market with less bureaucracy than this server.

  4. I think characterizing that as greed is unfair. Let the server make their money. And to be honest their monetization is pretty tame compared to the other Rage/FiveM and past SAMP servers I've seen. Also since we are going to throw around the word greed it works both ways. Greed is also wanting something for nothing. The way I think about it how much am I willing to pay for a brand new video game in exchange for the hours of entertainment I would get from it. I've gotten thousands of hours of entertainment from this server and to me its worth contributing financial to that. Walkstyles I get, /bad I understand the complaint but running a business isn't part of everyone's RP experience and nothing stops you from running a business without it. I understand the icon is incredibly helpful but I am fine with there being a carrot to incentivize donating.

  5. "Your honor we have a preliminary plea deal negotiated with the District Attorney's Office. My client is willing to plead guilty to all charges in exchange for time served. The only complication is the Contempt from Court Judge since that is under your discretion and not the District Attorney Office's we ask if you would consider dropping the charge in order for this deal to go forward. My client has served way more than the time recommended by the District Attorney's Office even if you were to account for a Contempt charge. And the dropping of the charge would allow for a swift conclusion to this case."

    And that people aren't waiting over 13 real life days for their not guilty cases to be looked at?
    And when the issues are brought up in the JSA discord about it, they don't just say "It's development for them". That doesn't happen?

    I was Co-Leader for JSA for a good period and have been in JSA since about September 2020. I've worked with the current leader for years and Leaders going inactive is nothing new (not saying the current one is), they get pushed out not too long after if they are truly neglectful. The issue is JSA is perpetually understaffed and will probably always be. It won't change with new leadership. This server population is massive and the influx of cases is never ending. Active Judges are hard to find and the ones we can find often get burnt out over the massive influx of cases and warrants that come in, same with District Attorney's. I am currently an appellate Judge and for me to do an in-depth appellate decision I've spent 4+ hours on decisions multiple times diving into court precedent and doing research.

     

    You can't expect systemic problems that exist in real life to be fixed when we are roleplaying that system. Court is slow in real life, trials can often take years. People are in and out of inactivity and you might have to wait days to get a response from someone. Say if we pushed out every lawyer, judge or prosecutor who took a few days to respond we would have no one in this system. I've played long enough to understand peoples playing habits are rarely sustained. They will have spurts of activity and them maybe after a few months become inactive or move on all together. Are you willing to dedicate a character slot to join JSA and help us with the load?

    Yeah that was my reply because street racing is just as valid roleplay as any other illegal roleplay on this server. You don't get to decide what other people can roleplay if they are operating within the rules. If you get lag slammed and the other person doesn't realize, who cares? Yeah it sucks we have sync issue but that is what you get on multiplayer mods that push the limits of vanilla games, sync isn't perfect. You spend 3 seconds respawning your vehicle and move on. If it elevates to rulebreaking, report them or forum complaint them. If the complaint is the lax enforcement of OOC rules that is a whole different discussion. I'll leave it there.

    That's the point.

    What does forcing people into indoor tracks have to do with Roleplaying crashes? If this is just about people not roleplaying crashes that is an OOC rule enforcement issue yet people are bringing up IC things like stricter laws, capping car speeds and limiting people to race tracks. 

    That is my point.

    Then what is the point of bringing up indoor race tracks if its just about RP crashes? You already made your point. I don't agree with it, I don't need to be reminded of anything, because people are bringing up "solutions" that have nothing to do with what you claim is the focus of people complaints. If it was just an issue of people not Roleplaying then what does stricter IC laws have to do with that when its an OOC rule breaking issue according to you? You guys need to make up your mind is this about OOC rulebreaking and ignoring Roleplay or IC driving, street racers and traffic laws. Anyways have a good one.

    There are plenty of legal race tracks and options to race on the server now without having to blatantly be a nuisance to everyone around you.

    Is your argument there should be no room on the server for street racers and it should all be contained to a race track? Lets get rid of all criminal roleplay then by that logic since it has the potential to be a nuisance. And this is coming from someone like me who has stuck to legal Government roleplay for 90 percent of my time on this server. People don't roleplay to just drive like someone going to a 9-5 job. They want to emulate the things that are done in real life that they can't do like criminal roleplay and car culture of America that often has drivers weaving through traffic on a highway with a BMW 3 series or Infinite G37 or Scatpack. I see it all the time, people IRL driving like idiots in the States. Don't get me wrong can things be improved on? Yes, but the argument since there are racing tracks people shouldn't be allowed to engage in criminal driving roleplay like streetracing and street take overs is insane.
