    At approximately 0332 hours, while conducting surveillance in the Little Seoul area, I observed Philip Yih, a known suspect in a criminal investigation in Little Seoul. Yih was loitering with two other Asian males, later identified as Ethan Kang and Aiden Pho. Yih returned to his car and drove to Discount Electronics & Repairs before returning to Little Seoul.

    Based on prior surveillance, Philip Yih has been involved in drug exchanges. The exchange involved Philip Yih providing a bag to his associates which is commonly used to package and transport narcotics, along with a roll of money stacked in a way used to pay those involved in the drug trade. The observed exchange occurred in a manner that implied secrecy.

    It is my experience that the behavior exhibited by Philip Yih was consistent with that of a drug transaction. Dealers often refrain from carrying all of their narcotics on their person at all times. Instead, they tend to keep their supply close by in secure locations or in vehicles to which they have access to retrieve the desired amount only when necessary. They tend to keep narcotics close by but not on their person to separate themselves and the illegal substances to reduce the likelihood of detection. It is also my experience that firearms are an essential tool for regulating the illegal trade in drugs, including protecting shipments of drugs, enforcing debts, and resolving disputes.

    Further suspicion was raised by the actions of the trio (Yih, Kang and Pho). The trio was dressed in baggy clothing which provides space for individuals to conceal illegal items such as weapons or narcotics. Criminal street gang members often use loose-fitting clothing to hide contraband from plain sight, making it difficult for law enforcement officers to detect during routine encounters. Furthermore, they were all visiting a gas station without their registered vehicles and had distanced themselves from passersby and bystanders.

    Finally, Little Seoul is a high-crime area and a known base of operations for Asian criminal street gangs. Based on the observed activities and documented evidence, there were several factors that collectively contributed to the establishment of reasonable suspicion to conduct a cursory search of Philip Yih. A Glock, 30 rounds and a ziploc bag containing a white powdery substance were found on Philip Yih's person. The substance was later tested and was confirmed to be 82 grams of Ketamine. Philip Yih was arrested for criminal possession of a firearm and drug trafficking of a Schedule B controlled substance.

    III. SENTENCING RECOMMENDATION

     

    The Los Santos County District Attorney's Office also files in support of this arraignment to the Superior Court, the professional opinion of the office and shall be recommending the granting of the following sentences:

     

    • 7 Day(s) imprisonment.
    • $30,000 fine.

    IV. BAIL APPLICATION

     

    This matter coming before this court for setting of bail with the defendant present and being advised of their rights herein, the People of the State of San Andreas move this Honorable Court to enter an order to grant bail and in support thereof state as follows:

     

    That Defendant shall deposit, with the clerk of the court, $250.000 as bail security indicated on his bail bond with the following conditions:

     

    1. Appearing at all court dates.
    2. Refraining from alcohol or drug use and possession
    3. Undergoing alcohol or drug testing.
    4. Submit to electronic monitoring.

     


              Declaration        

    In conclusion of this complaint, I, Deputy District Attorney Katelynn Dunne, affirm that the above-stated facts are true and accurate to the best of my knowledge and belief. This shall be the official arraignment for the Superior Court to commence proceedings.

  2. Since it seems the Defense has decided to jump right into attempting to dismiss all charges without the People even being remotely asked their side, let me break it down for everyone in this courtroom today. 

     

    The Defendant was confirmed to be the suspect who was fleeing from law enforcement, and also robbed the vehicle that's spoken of. In a sworn affidavit by the arresting Deputy, which we'll consider the Arrest Narrative being, the Deputy outlines that the Defendant was in fact the person they were after. The arresting Deputy witnessed a black Declasse Impaler LX; SA index VBA615, that was reported earlier in the day to have pulled a gun on a citizen and then attempted to run them over. 

     

    The Deputy turned on their ELS in an attempt to pull the vehicle over, in which the driver was later identified as the Defendant, who decided to continue driving and ignore the Deputy attempting to pull them over. The Deputy even went as far to drive a bit closer  to the Declasse Impaler LX to ensure that the driver heard the sirens, it was at this point the Defendant continued to evade. 

     

    The Deputy requested for assissstance to A-TAC1 at the time, thepursuit itself was later terminated on Rub Street near an apartment complex where the Defendant ran inside. The Deputy's ran after the Defendant following a hot pursuit protocol, although they'd lost sight. 

     

    This is where a canine was called to the scene who eventually managed to track the Defendant down, in which he was apprehended. The vehicle; the Declasse Impaler LX that the Defendant had been evading from law enforcement in, also had loose wires and a clear indication it had been stolen after the registered owner being reached out to. 

     

    The case, Your Honor, if I may, seems pretty clear and simple  to the People. We're not going to argue back and forth with the Defense, instead this'll be our only input unless asked specificially again.

  3. The People are recommending the Defendant be sentenced to life imprisonment for the following:

     

    In a sworn affidavit written by the arresting Deputy; Riley Ruiz, on the 31st of March 2024 at approximately 4 AM, the Deputy responded to an assisstance request from another Deputy; 110  William 2 Deputy Michael Hughes. 

     

    The initial assisstance request was for a Street Takeover commencing in Legion Square, upon arriving on scene and turning on the emergency light system, Deputy Ruiz was approached by the Defendant, whom stood infront of the Deputy's car and demanded they turn off the sirens. The Deputy disregarded the request, at which point the Defendant walked to the passenger side of the vehicle and began to punch and kick the glass of the Deputy's cruiser's passenger window; shattering it entirely and the door panel itself.

     

    The Defendant opened the Deputy's door, at which pointt he Deputy drew their service pistol and ordered the Defendant to back off. The Defendant then uttered the remark: "I got one too, I ain't scared of you hoe." Then he walked off, shouting: "Let's starting capping these pigs". This could only be described as what one would say, an effort to incite violence against law enforcement. 

     

    A little while after, the same Deputy  collided head on with a black Cheval Picadoor; SA plate QST500. The Defendant was driving the vehicle, which is written in the sworn affidavit as the Deputy wrote, although I will change the Defendant's name to the Defendant in these  upcoming quotations for respect of professionalism: 

    "The impact was low speed, damaging the Defendant's vehicle more than my own. Jerome Sasser then proceeded to join in with the Street Take Over in his own vehicle. Drifting around the intersection, colliding with other participants and other radio cars as they attempted to disperse and stop the vehicles from continuing their reckless behaviour on public roads."

     

    The Defendant then pulled out of the intersection, and turned back towards them, driving at a high rate of speed straight through the Street Takeover, and even clipping with other vehicles. This in itself is clear negligence and displays a lack of care for public safety and law. The Deputy attempted to stop the Defendant by intercepting him with the crusier, at which point they collided again. The Defendant then turned around and took off, which initiated the pursuit. 

     

    The Defendant lead LSSD personnel on a long winded, dangerous and intentionally deadly pursuit through Los Santos' city streets, as the sworn affidavit says. The Defendant then drove through the Davis LTD narrowly avoiding traffic both vehicle and pedestrian. The Defendant drove over sidewalks, cut through alleyways and drove along pavements in order to attempt to flee pursuing law enforcement officers on his tail. 

     

    Now, the People want to point out the major concern and twide turning event that happened here, which I'll quote directly from the arrest narrative:
    "At approximately 04:20, the Defendant drove through the Davis LTD Gas Pumps from Grove Street onto Davis Avenue, in doing so he struck a young male in a white hoodie sending him roughly 10-12 feet in the air and into the road. At this time, it was decided that we needed to stop the Defendant and the authorisation to use lethal force was given if necessary. I made several attempts to intercept the Defendant and keep him away from his favoured crowded areas, though these attempts did not seem to deter him from making his way back to the Davis LTD."

     

    His last attempt of trying this rendered his vehicle disabled, he then exited it and climbed into the back of a parked up Rebel pick up truck. Deputy Ruiz instructed him to get out of the truck bed and show his hands, at which point the Defendant opted to lay down in the bed and not comply with the deputy's orders. This is when the Defendant was struck with a beanbag, the driver of the Rebel was ordered out of the truck, when he did, the Defendant continued to disregard the orders of peace officers and was struck a second time with a beanbag.

     

    It was at this point that the order to move in on the Defendant was given, and take him into custody. He allowed himself to be, although with little resistance

     

    Upon arriving to Davis Station, whilst trying to get the Defendant out of the car, the Defendant LUNGED at the Deputy at which point; Deputy Spectre tased  the Defendant from behind. The Defendant collided with the Deputy due to that and took himself and Deputy Ruiz to the ground, pinning the Deputy down to the ground. The Defendant then BIT her right arm and took a hefty chunk of flesh out with his teeth. 

     

    Due to Deputy Ruiz's fighting back and Deputy Spectre's help, and the LSFD personnel on scene who sedated the Defendant, the Defendant was able to be restricted and kept back. 

     

    Your Honor, if I may add; these events are that of an animal, a savage, not a man who's mistakes lead him down a bad path, not a man who committed crime because he had no choice to feed his family, but an animal who doesn't value human life or human feelings.

    Your Honor, I'm not going to try an argue back n forth like the Defense here is trying to do but instead I'm going to just look at the facts of this case presented before us in this very court. 

     

    The sworn affidavit written by a sworn in peace officer of the state clearly states that the Defendant had a fanny pack on him at the time of the search, in which two ounces of Marijuana were found. Bare in mind, that's basically almost three times above the legal limit. 

     

    There's no evidence of a Fourth Amendment breach, the Defense likes to say that the People are speculating here, but isn't assuming that a warrantless search and a Fourth Amendment breach being violated; in fact, speculation? Whilst I'm going off of the facts of this case, and being accused of speculating whilst following the facts of the case, the Defense is the one in fact throwing around speculative accusations. 

     

    The Defense says I'm speculating the whereabouts of the fanny pack, correct? Let me indulge your attention for a little longer Your Honor, the real meat and potatoes of this whole thing before us like I mentioned already: 

     

    The Arrest Narrative specifically states: 
    "During a search of Tyler Edwards, a small fanny pack contained 56 grams of dried Marijuana..."

     

    This once again means it; by it I refer to the fanny pack with two ounces of Marijuana on it, was found on the Defendant's person. Once again, this is a written sworn affidavit by a peace officer, and unless the Defense can prove that the oficer lied on the aforementioned affidavit, it's considered evidence in the court of law.

    That, Your Honor, is in nowhere, in any shape or form a speculative assumption on the People's behalf.

    Police Officer II Max Sullivan (#145270), Police Officer II Edwin Ramirez (#133206), Detective II Francis Simmons (#11530), under the callsign 2L43, 2L56, 2N20 on the 21/APR/2024, 02:33. Conducted an arrest on Gregory Silva, the apprehension took place on Little Bighorn Avenue and Vespucci Boulevard, Mission Row.

    Arrest Narrative:
    Officer Max Sullivan under callsign 2L43 witnessed a scene at approximately 01:20 a.m. in which five IMEX employees had circled an injured male lying on the ground with a baseball bat near him. The injured male was later identified as Alvin Malburg. The incident took place behind the Mission Row Station on Little Bighorn Avenue and Vespucci Boulevard, next to the Sally Port. Unit 2L43, at the time, was transporting an unrelated suspect for another officer, Edwin Ramirez, under callsign 2L56, before coming across the scene while on the way to the Mission Row Station. 2L43 returned to the scene after handing the suspect to 2L56 for processing. Upon arrival, 2L43 found a female IMEX employee crouched next to the aforementioned injured male, Alvin Malburg, on the ground, with the said baseball bat on the ground near him. The female IMEX worker checked for his vital signs and she told the officer that he was unconscious and that his pulse was weak. 2L43 inquired the individuals at the scene about what had happened to the male to get some insight after securing the baseball bat. Gregory Silva, an IMEX driver, responded positively after Officer Max Sullivan asked if the downed male was beaten up. The others followed shortly after, unanimously agreeing on the notion. The injuries of the male were visible, and from a glance, they were consistent with the type of damage explained to the officer. Alvin's face appeared to be battered and he was unconscious with a weak pulse. An RA was called by 2L43 and it took approximately 15-20 minutes for the EMS to arrive before he was pronounced dead on scene with a broken neck. Before the EMS arrived, however, Alvin was detained in handcuffs after the IMEX workers claimed that Alvin had attacked one of their first, Gregory Silva, who beat him up as a consequence, purportedly in self-defense. 2L43 then started taking statements from the individuals at the scene while waiting for the EMS. During the wait, 2L56 arrived at the scene unprompted at some point and decided to assist 2L43. A few minutes later, Detective Francis Simmons under callsign 2N20 arrived as well in order to help, coordinate, and conclude the scene. It was later found out that only one person was present in the incident apart from Alvin Malburg, and it was Gregory Silva, the IMEX worker who beat up Alvin in purported self-defense as mentioned before. Gregory Silva told Officer Max Sullivan that he was traveling within the city from one point to another to drop off his supplies as a van driver, doing his typical job. He dropped off some supplies for a phone store in Textile City before Alvin Malburg hit his 'Speedo' model company van from behind with his 'Bürgerfahrzeug Surfer' model vehicle with the plate "YVZ512" when he was about to radio in his next route. Gregory then followed the direction that Alvin went and found him also crashed into another parked vehicle on Little Bighorn Avenue, whose owner was nowhere to be seen. He then got out of his van to prepare to interact with him to get insurance information or his plate just in case. He called the police beforehand to ensure his safety and so that Alvin wouldn't get away from the accidents he caused. Before Gregory could approach Alvin to talk, however, Alvin walked up to him first with a baseball bat and then chased him, after which Gregory managed to tackle Alvin to the ground and beat him up. Gregory also said that an unidentified male wearing a bird mask approached the scene shortly after pacifying Alvin, blurted out a few words, and then took off in Alvin's vehicle, which had been left on the road with a running engine. It was also found that the other IMEX workers arrived after Gregory asked for help through his company radio when no officers responded to his initial 911 call about Alvin rear-ending his van, which was made at 01:10 a.m. Therefore the IMEX workers were not witnesses. After 2L43 was done collecting evidence, it was found out through dashcam footage acquired from the van that Gregory drove, that Alvin Malburg initially chased Gregory with a baseball bat for a few seconds before Gregory tackled him to the ground and repeatedly stomped him until he was unconscious and ended up with a broken neck, leading to his eventual death. Upon several inspections of the dashcam footage by 2L43, 2L56, and Detective Francis Simmons, it was decided that Gregory Silva's actions were beyond self-defense and that he would be charged with IC - 204. Voluntary Manslaughter due to him stomping the assailant to death, who was already tackled to the ground, rendered ineffective, and reasonably pacified. He was handcuffed by Officer Edwin Ramirez and had his Miranda Rights read to him by Officer Max Sullivan, who also transported, processed, and booked him.
