Brief Summary of Situation: I heard gunfire whilst I was at the Davis sheriff's station coming from across the street, toward the apartment complex. Because of this, I ran across the street, between the park and back of the complex, and down an alleyway as it opens up toward the staircase as seen in the attached video. David Moser (me) sees an individual on the ground and another individual standing over the top of them, at which point my character requests immediate assistance via a "997".
997 means "997 — Deputy requires assistance urgently, all nearby units respond", it's an emergent call which is seconded to only deputy involved shootings (998) and 999 "everyone respond" broadcasts. I know immediate assistance is coming to my aid. As you can see in the video I give commands to Brandon Poole and he puts his hands up. This is an important point in the situation.
Whilst I say I have one at gunpoint, Poole takes off. Poole runs, with his hands still up, toward 107 Roy Lowenstein Boulevard and goes inside. Attached in the evidence is a still from the video, which features a screen door & balcony. I know, and Moser knows (having seen it happen before) that it's commonplace to run through the building, out the screen door, hop the balcony and attempt to escape. I assume (Moser assumes) this is what Poole will do.
In accordance with "hot pursuit" (the immediate and continuous pursuit by police officers of a fleeing suspect whose possible escape justifies the failure of the officers to obtain a warrant before making an entry, search, seizure, or arrest), I follow Poole who had his hands up when entering 107 Roy Lowenstein Boulevard inside. It's at this point where I see Mask_D8898_17, who has his gun up at me. We trade shots and he goes down. Moser broadcasts the 998 I mentioned before (deputy involved shooting) at which point Mask_B1D21_3 comes down the stairs, and a second gunfight occurs. Moser goes down. The totality of the injuries are four shots to the chest and two to the arm.
Mask_B1D21_3 and Mask_D8898_17 were, to my understanding, engaged in a completely different situation. Poole ran into 107 Roy Lowenstein Boulevard to attempt the "balcony strat" (for lack of a better term) that I mentioned earlier. Poole, nor I, were aware Mask_B1D21_3 and Mask_D8898_17 were inside; it was completely coincidental.
The actions of Moser were compelled by the fact that a shooting had occurred and Poole was standing over a person bleeding on the ground. Poole takes off, keeps his hands up, and did not pose any form of lethal threat (e.g. a firearm in his hand), though his apprehension was understandably (in my eyes) paramount for questioning/detainment. I was force CK'd by admin Seanny for running into the building after Poole and showing a lack of fear RP.
My reasoning for this appeal is on the basis of an emergent "all Department cars in the area respond to my assistance call" 997 broadcast before the foot pursuit occurred, as well as the close proximity to a sheriff's station and all the Department personnel it would hold. Moser (& myself) thought (and knew) assistance was coming in very, very brief amount of time (as seen in the video with 280 George 13 and 280 Sam responding).
