Following State of San Andreas vs. Adrian Collins the charges would be dropped. However, in his case this was a CK, but I don't see why in case of a PK the situation would be continued, the defendant would have to notify an admin that they've died (of course, as soon as it's confirmed it was related to the case) and they get all their charges dropped and case is closed as the subject is dead.

 

Can this be abused? Absolutely, this would imply that if you get killed during a court case by the opposition it's a get-out-of-jail free card for your IC record, but then you'd be dead, losing all information on what happened and LSPD gets to find out how the defendant died if they wish to pursue that path, a realistic outcome.

That's not how it goes. Only if it's a CK, then the case is dropped.
