The State of San Andreas v. Erick Rivera

 

By decree of the State of San Andreas Penal Code and enforcement authority of the San Andreas State Constitution, on MARCH/25/2021, the defendant Erick Rivera has been officially arraigned by the State of San Andreas by officials of the District Attorney's Office for violations of public safety/decency for the following charges;


  • MC 114. Resisting Arrest
  • FC 119. Evading a Peace Officer
  • FA 606. Discharging a Firearm in Public
  • FC 608. Possession of a Firearm by Convicted Felon
  • FA 209. Second Degree Murder

In accordance with the Penal Code statutory law, the District Attorney's Office shall be recommending to the Superior Court for the granting of the following punishments;

 

  • LIFE in state penal confinement without parole elegibility.

In support of the provided narrative, the following evidence shall be submitted into the court record; 


Exhibit One - Arrest Report

Police Officer III Lucy Kenway (#30069), Police Officer I Luciano Sapo (#55343), under the callsign 2-ADAM-15 on the 24/MAR/2021, 21:30. Conducted an arrest on Erick Rivera, the apprehension took place on Great Ocean Highway, Pacific Bluffs.

 

Exhibit Two - Arrest Narrative

Officer Kenway and Officer Sapo were responding to a fight call on Vespucci Beach under 2-ADAM-15. As they arrived on scene Detective Creason and Officer Bradshaw were already on scene and said that the group of people were fighting each other and wanted to go talk to them in order to tell them to take their fights private. Upon approaching we were all immediately swarmed. It all started with Matthew Garza here in question pulling Officer Bradshaw and tossing him into a bowl pit at the skatepark as a whole fight ensued and we all were broken up. Each Officer was fighting off two or three suspects as we were outnumbered heavily. Officer Kenway herself was fighting off three suspects with her baton out upon hearing shots and running towards them in fear for her fellow Officers life.

As she ran eastbound from the skatepark she was able to see Officer Bradshaw opening fire but not exactly seeing who was he shooting at, as she saw a white figure in black clothes behind a rainbow wall on the beach, aiming their pistol at Officer Bradshaw and opening fire, wounding him as the Officer fell down. Officer Kenway ran towards the shooter, unloading two magazines towards him as the suspect began running off down the beach. Moments later as the chase ensued a black sedan pulled over behind the shooter, aiding him into the vehicle into the passenger seat as the responding units that were arriving on scene began chase after the vehicle into a vehicle pursuit. During the pursuit one of the suspects in question in a black outfit got out of the vehicle into a footbail and was quickly apprehended by Officer Torrez in Strawberry as the vehicle took off and continued pursuit. A firearm was found on the suspect which looked like the shooter's weapon. The suspect was identified to be Erick Rivera who already has prior charge for a murder. He was put into custody and transported to TTCF. Officers eventually got the pursuit to end on Great Ocean Highway as the driver of the vehicle was identified to be Matthew Garza who was the shooter's accomplice.

Officers at the scene in Vespucci by the skatepark who were able to set up the perimeter recovered the casings from the shooter which Forensics were able to match with Erick's firearm that was found on him, directly tying him as to being the shooter himself that killed Officer Bradshaw on 24th of March 2021.

Officer Kenway who arrived at TTCF was able to process Erick Rivera along with Officer Thompson where he was charged accordingly

 

Exhibit Three - Cruisers Dashcam

*You would be able to see on the dashcam footage from the cruiser's in the pursuit line on 24th of March that a male from the passenger seat would exit the vehicle in Strawberry before taking off sprinting*

The District Attorney's Office also files in support of this arraignment to the Superior Court, the professional opinion of the office on conditional release for the defendant, pending the conclusion of this trial if a verdict of guilty is reached. The recommendations for this opinion are as follows;


  • Grant release on basis of time served. [NO]
  • Grant eligibility for parole, pending supporting conclusions from Parole Board. [NO]

In conclusion of this arraignment. The District Attorney's Office affirms that all information submitted is accurate, and truthful given all the information and evidence available, and has been affirmed by Deputy District Attorney Cyril Regas that this shall be the official arraignment submitted for the Superior Court to commence proceedings.
