  1. Hey there, Mitchell Hughes' player here. I'll address the situation in more detail below.
     

    Myself and Ada Hsu responded to a call for assistance at Davis LTD where there were multiple deputies near the intersection between Davis Avenue and Charleston Projects. A supervisor told us to go out on a canvass around the area to look out for a male in a black hoodie. I drove towards Charleston Project's parking lot where I noticed somebody with a black hoodie, who turned out to be Daevon Parker. We stepped out of the vehicle to approach him. Although we wanted to detain him, we didn't give the impression that we were about to do so. All my character did was ask him to move to the back of the vehicle to have a word with him.
     

    Out of nowhere, he decided to walk away, so we tailed him. I attempted to block his way into the apartment; however, he still ignored the fact that I was trying to RP with him or attempt to prevent his entry. He went inside the apartment to stash whatever he had on him and then walked out, giving us a chance to pat him after he stashed his items.
     

    Ada then started frisking him and I was about to call for assistance over the radio when Angel Gomez, Montez Brown, and Michael Vaughan began roleplaying punching me and started to punch me scriptwise, which I wasn't able to fight back against due to being in animation. I couldn't call for backup or even roleplay back, which I find unfair. If what I did is considered lacking fear, then what about half of the group, most of whom are teenagers or minor characters, who showed no fear towards two armed deputies who could potentially call for assistance if things escalated, especially since we had around 7-8 units near the lot? If you expect me to treat minor characters the same way as elder characters, then I guess I should ignore the fact that they are minors and treat them the same way as non-minor characters. The whole situation was poorly escalated from their side, not ours.


    I backed out and pulled my gun based on the fact that my character is a deputy who is being physically assaulted and has no potential to seek backup or assistance at this point unless I hold one of them at gunpoint, which I attempted to do. I had my gun out first, so I'm not sure how I lacked fear in this situation, and also I'm not going to assume that all minor characters are armed, realistically or in terms of roleplay.


    Shortly after, I got tackled by Michael Vaughan, and then Angel Sanchez began stomping on my character. Again, they resorted to an option that could lead to lethal force being used from our side because my character's life was at risk here. Ada tried to help Mitchell in that situation by shooting those who were stomping on me, and then, as seen in the clip MASK_7C8AF_18 on a bicycle drove by with a sawn-off shotgun, which he got killed with two-three others shooting at Ada, and then I got shot as soon as my character got up, at which point I shot back and died.

  2. "Your honor, the officer's statement regarding the defendant's actions is present in Exhibit A, the arrest report, which has been provided as evidence already. The report even states that 'Officer Ortega' offered assistance, it implies their potential availability for testimony or such in court. Keep in mind that we were never asked for information about potential witnesses during the discovery; however, we would be more than happy if a subpoena was submitted to call Officer Ortega as a witness for questioning.

     

    As for the defense counsel's assumptions that the defendant may have been out for a jog or attending a friend's house, we would like to bring attention to the fact that the defendant didn't call 911 or try to comply with the officers, rather he decided to evade them. The defendant had nothing to worry about so he could evade the officers but rather he only did it, making me believe that the defense is luring us out of the topic and misleading the court with false information."

    "Of course, your honor. The prosecution objects to the motion since there is a reasonable suspicion for the charge given, which is later raised to a probable cause. First of all, let me explain the basis for this. As you can see in the third-second frame of the dashboard camera footage, the defendant was observed returning to the vehicle to attempt to approach it once again until he noticed the arresting officer and then attempted to run away. The defendant was called over so the officer could question him; however, he did not comply and instead dashed away after coming back. Now, if the defendant did not commit such an act, why would he resist the arrest in the first place? He could have stayed and complied with the officer's orders until he was instructed to leave. Keep in mind that the defendant was the only one seen in the area and on foot. I believe that the evidence does not lack at all, rather there is a dashboard camera footage with the officer's statement and witnesses who've been offering assistance to the arresting officer."

    I. CRIMINAL COMPLAINT

     

    By decree of the State of San Andreas Penal Code and enforcement authority of the San Andreas State Constitution, the Defendant, Andrew Cho, has been officially arraigned by the State of San Andreas by officials of the Los Santos County District Attorney's Office for violations for the following charge(s):

     

    COUNT 1

     

    • FC 306. Grand Theft Auto — On February 7th, 2024, in the county of Los Santos, the Defendant did commit Grand Theft Auto when he was observed wearing grey clothing, running up to the vehicle. He then tried to walk away before being called back over by the arresting officer. Upon the defendant approaching the cruiser, he decided to flee away into a garden downhill. The defendant eventually fell down the cliff and was transported to PHMC before he was detained and arrested.

     

    COUNT 2

     

    • MC 116. Resisting Arrest — On February 7th, 2024, in the county of Los Santos, the Defendant did commit Resisting Arrest where he was called over to the cruiser by the arresting officer before he decided to flee away into a garden downhill.

    Report:
    Lieutenant II Rebecca Jones (#36670), under the callsign 2T10 on the 07/FEB/2024, 00:16. Conducted an arrest on Andrew Cho, the apprehension took place on North Sheldon Avenue, Vinewood Hills.

    Arrest Narrative:
    Lieutenant Jones was responding to a vehicle alarm triggered on North Sheldon Avenue. When arriving on scene we can see a man in grey clothing running up to the vehicle. When Lieutenant Jones rolled up and turned my lights on the suspect who was later identified as Andrew Cho started running up the hill. Lieutenant Jones then addressed the man to stop and to come back to the cruiser. The man then decided to walk towards the cruiser before dashing away into a garden and down the hill. The suspect fell down a cliff and Lieutenant Jones went the long way around and even they slid down. An Ambulance was called for Mister Cho. When Lieutenant Jones was dropped off at her cruiser by Canine Officer Ortega they ran the plate of the black Karin Sultanwhich was parked down the road of the alarm which can also be seen on the dashcam when Lieutenant Jones arrived on the scene. The Sultan came back to Andrew Cho. Upon arrival, Andrew Cho had already according to them Sister and boyfriend sitting in the bay once the suspect was cleared by the hospital he was taken to MRS where he was frisked and taken into custody.

    III. SENTENCING RECOMMENDATION

     

    The Los Santos County District Attorney's Office also files in support of this arraignment to the Superior Court, the professional opinion of the office and shall be recommending the granting of the following sentences:

     

    • 7 Month(s) (( 7 Day(s) )) imprisonment.
       

    IV. BAIL APPLICATION

     

    This matter coming before this court for setting of bail with the defendant present and being advised of their rights herein, the People of the State of San Andreas move this Honorable Court to enter an order to grant bail and in support thereof state as follows:

     

    That Defendant shall deposit, with the clerk of the court, $300,000 as bail security indicated on his bail bond with the following conditions:

     

    1. Appearing at all court dates.

    In conclusion of this complaint, I, Assistant District Attorney Luis Ocasio, affirm that the above-stated facts are true and accurate to the best of my knowledge and belief. This shall be the official arraignment for the Superior Court to commence proceedings.

  5. "I apologize for the delay, your honor, and of course the defense. Unfortunately, we had unexpected internal circumstances from outside that we had to divert our attention to."

     

    * Luis Ocasio clears his throat and addresses the courtroom with his opening in return, glancing around while doing so.

     

    "It is too difficult to show leniency in this case for multiple reasons. The defense stated that we need to consider that Nicholas is a human being like you and me, like everyone here in the courtroom. However, it is seen from the footage that Nicholas never really thought about what he was doing. It is more likely that he decided to shoot the cop and leave him in a pool of blood already.

     

    Mister Trompower never really hesitated while committing the said charges. With cold blood, he pulled his gun out and shot the deputy on sight. If Mister Trompower is a human being that we have to be lenient with, then I guess what the defense is trying to tell us is that Deputy Wo was not one, which I find disrespectful toward someone who did nothing but perform his duties as a cop.

     

    The deputy only pulled Trompower over for a traffic violation; he was a human being who tried to do nothing but advise Mister Trompower to drive carefully, and yet this was his end. We have to keep in mind that the family of the deputy depended on the deputy himself as their only support. Mister Trompower did break a family apart and shattered them at all costs.

     

    We, as the People, stick to our decision, and we believe that the recommended sentencing is the best for all parties"
