    Lashay Aldridge v. State of San Andreas

     

    In this writ of habeas corpus, the petitioner requests the presence of Lashay Aldridge, who is being held or unlawfully detained by authorities on the following presumption;


    • No Arraignment After 72 Hours.

    I, Petitioner Maya Vidal, as an agent of Lashay Aldridge, confirm that all information submitted in this petition has been lawfully obtained, and is recorded and recollected to the most factual and truthful standard to be accepted for review by the Superior Court.

  2. ** Maya Vidal nodded back to Kenneth. She then rises from her chair looking up to the Judge's bench. She would walk towards the center of the court room. She nods to the judge before she begins speaking**

     

    "Firstly, my apologies for all the delays with this case."

    ** She clears her throat, looking around the courtroom once, before settling her gaze on the Judge's bench again **
     

    "The prosecution wants to accuse my client of firstly, impersonation an officer of the law, in order to rob the victim. In order to prove that, the prosecution's evidence is dubious at best. The claim that my client was impersonating an officer is ridiculous, considering he was wearing no badge, not at the time of the alleged incident, nor at the time of his arrest, where my client cooperated fully with the Police Department and made absolutely no effort to get away nor avoid the officers responsible for his arrest.

    Instead, he simply surrendered, trusting that the system will eventually prove his innocence. From all the photos and other evidence the prosecution has provided there is a crucial item that no reference is being referred to. A police badge.

    As we're all aware, every police officer is issued with one, and it serves as proof that said person is, indeed, an enforcer of the law. My client is /not/, an officer of the law, hence, he never had a badge, nor did he ever pretend to have one.

    This so called LS County Sheriffs uniform replica only consisted of a light brown shirt, and dark green pants, coupled with a pair of utility boots and a leather belt. These are not uncommon items of clothing, and wearing them does not mean that one is impersonating an officer. 
    Is the prosecution going to arrest every hunter, or guard in the state based on the fact that they worse a shirt that was the wrong color?


    Furthermore, my client was identified based on his race, a haircut and the car he drives. I very much doubt he is the only person in the County with a love of vintage cars, utilitarian clothing and who happens to be bald. The so called proof that the prosecution is basing their second accusation of armed robbery on is the testimony of the alleged victim. If, in fact he was robbed like he claims he was, he would have obviously been in distress and the defense does not believe the statement of a person in that condition is enough to charge my client without further evidence.

    People confuse perpetrators all the time, and punishing someone based solely on that is risky at best, and at worst, is serves to put an innocent man in prison, while a guilty man goes free.

    For these reasons, the defense does /not/ agree that the evidence is enough to convict beyond a reasonable doubt, nor that there was any probable cause involved in the arrest."

    ** Maya Vidal would nod firmly as she finished the statement. After being dismissed she would return to the Defense table, where she would flash a quick smile to Kenneth, awaiting the response of the opposing party. **

    I, Petitioner Maya Vidal, as an agent of Nikolas Bond, confirm that all information submitted in this petition has been lawfully obtained, and is recorded and recollected to the most factual and truthful standard to be accepted for review by the Superior Court.

  4. *Maya Vidal strolls into the courtroom, rather hurriedly, making her way to the Defense table. She places her suitcase on the table, before addressing the court.*

     

    "Maya Vidal for the Defense, Your Honor."

     

    *She clears her throat, slightly embarassed.*

     

    "Your Honor, I apologize for the delay, and I understand that the accusations are of a very serious nature, but I feel that I must recuse myself from this case. I have read through the evidence provided, and I realized that I have both personal and professional links to most of the parties mentioned.

     

    As such, I don't feel that I can provide an adequate defense, because of this conflict of interest. The defendant is deserving of an effective defense, and as such, I strongly advise him to not represent himself in these proceedings. I have arranged with another public defender to represent Mr. Scott."
