Just because people a lot of people are drifting away from the OP's point, California doesn't exist in our world and the judicial system or laws for that matter have never been based on California, all of these points are moot. Even if someone wanted to bring up California into this discussion for some reason, I'll reiterate that the death penalty is still a thing in California and people are sent to death row monthly — the only thing occurring in California right now is that there's an executive order merely halting the execution of those death penalties, there's a huge difference. The executive order is not permanent and it could be changed at any point of time, there have still been cases of executions despite the executive order.
