On the 4th of July at approximately 2200 hours, deputies with the Los Santos County Sheriff's Department responded to a 911 call on Covenant Avenue, Davis, in Los Santos regarding reports of criminal threats. This situation was observed to have involved 15-20 civilian subjects as well as employees from both the Los Santos County Sheriff's Department and Los Santos Police Department. 

 


During this situation, Sergeant Nathan Tavares from the Sheriff's Department used a racial slur to insult one of the subjects of the initial complaint. Civilians present on this scene began to be violent towards present law enforcement who were then forced back to form a line in a defensive position. A deputy observed a male subject rapidly approaching a police officer from behind with a blunt object and opened fire with their standard duty issued firearm towards the assailant in order to preserve the wellbeing of the police officer and neutralize the threat. 

Immediately after the use of force, a large crowd began surrounding law enforcement still on the scene. Verbal attempts were made to get those gathering to disperse away from him to no avail. At 2211 hours, a male who was confronting law enforcement was struck in the back of the head by another male, causing him to stumble into the line of deputies. Promptly following this, Deputy Ellis Kane discharged five rounds from his service weapon towards the male who had approached before ejecting the magazine, Deputy Kane claimed to have seen a bladed weapon within this male's hand, however, witness and dash-cam evidence prove that this male was unarmed at the time of his approach. Three of the rounds were discharged as the male fled from police into the group of people and are believed to have struck uninvolved protesters.

On the 5th of July, 2020, at approximately 1930 hours, Ellis Kane and Nathan Tavares were placed on administrative leave pending the investigation.  

On the 6th of July, 2020, Ellis Kane was discharged from the Department for "gross misconduct resulting in significant harm to members of the community" and "criminal negligence stemming from breach of official use of force policy". The Los Santos County Sheriff's Department in conjunction with the San Andreas Districts Attorney's Office worked to pursue criminal charges against Ellis Kane for his gross misconduct and criminal negligence, Ellis Kane has since pleaded guilty to the charges against him and will serve his sentence within the Twin Towers Correctional Facility.

On the 7th of July, 2020, Nathan Tavares was discharged for "tarnishing the reputation of the Department while acting as a supervisor including conduct resulting in a gross violation of MPP 1-01/040.00 GENERAL CONDUCT.". The Internal Affairs Bureau has also issued official reprimands to employees who handled the situation poorly, this includes a supervisor who will remain unnamed at this time.

As promised, the Los Santos County Sheriff's Department has taken swift and decisive action against the deputies who failed to conduct their duties in a way that is aligned with the values of the Los Santos County Sheriff's Department. The arrests and terminations conducted by the members of the Los Santos County Sheriff's Department with assistance from the San Andreas District Attorney's Office are only a part of our effort to weed out corruption and those who tarnish the reputation of the Los Santos County Sheriff's Department. The Department, and the vast majority of its employees, embody the very spirit of diversity and justice for all, ensuring that everyone we serve is treated with the highest level of dignity and respect. We have fostered many amazing partnerships and relationships with the people of San Andreas and without a doubt, this will continue though we must continuously work to improve to ensure that the community can trust that our deputies will continue to uphold the core tenants of the Los Santos County Sheriff's Department.

The Los Santos County Sheriff's Department thanks the community endlessly for their patience during this time of civil unrest, the Department stands for equality for all members of the community. The Internal Affairs Bureau will continue to investigate this incident, maintaining the public's trust in law enforcement is crucial and is the foundation to community policing, the Department has zero-tolerance for any employee that would violate that trust.

Comment: These deputies did nothing wrong. They were surrounded by animals and needed to take appropriate measures to protect the community and their fellow MAN.
