House Party Raided, Marijuana Use Suspected

A house party at La Puerta was swarmed with LSPD officers on the 23rd. The Sevencz affiliate hosted gathering took place out of an 3362 Bay City Avenue. Upon arrival the attendees gathered outside, with one fleeing from the police before being taken down. 

 

Unhappy with their uniformed party crashers; those hosting the party were vocal with their frustration. The legal culpability of the LSPD's actions have also come under fire for potentially violating the principles of reasonable suspicion, probable cause and their general right to search.

 The LSPD and their K-9 handlers were terry frisking those on scene as it was clear that drug use was suspected, yet a terry frisk is used for weapons and makes for an ineffectual method to search for narcotics.  Those on scene included a Captain who claimed they were conducting these terry frisks for officer safety, however when asked for their reasonable suspicion to justify the search, there was no clear response.

 

The aforementioned Captain also said: “We do not owe you an answer for that.”

 

The key host, a Sevencz brand representative best known by the alias "Rot Garden" had put an arm around the Captain, who claimed it was assault and had him arrested. The definition of Assault as is written in the 2019 revision of the San Andreas Penal Code states: 

 

119. Assault & Battery on a Government Worker

Any person(s) with the intent to injure, maim, or otherwise harm a member of the government while conducting official duties.

 

Later it was discovered that Rot Garden was not charged for assault.

"Rot Garden" stood ahead of an LSPD Captain shortly before his arrest. The LSPD Captain later resorted to sarcasm over the alleged assault and joked at the expense of Rot Garden's ginger complexion.


 As noted in the 1968 Supreme Court case Terry v Ohio which it owes its name to, the terry frisk is defined as:

 

"A protective search for weapons in the absence of probable cause to arrest (is valid) because it is unreasonable to deny a police officer the right to neutralize the threat of physical harm when he possesses an articulate suspicion that an individual is armed and dangerous."

 

Without the precise information of the police tip-off, further interpretation is difficult.

Because of internal LSPD policy, only those of their Media Relations and Community Affairs Division (MRCAD) are permitted to issue statements to the media. In a later pair of statements shared by Lieutenant Samantha McGill; the LSPD had received an anonymous tip of illegal drug use at the household. Therefore it was their “responsibility to enforce the law”.

 

Of the Captain, McGill stated: “I can assure you has many years of experience and it would’ve been a misunderstanding.” She was unable to disclose the name of the Captain due to "data protection and the nature of officers on scene" akin to how their press releases typically avoid naming specific officers for their protection. 

 

To the accusations of the LSPD withholding information, she said: "Everyone I came across the nature of why they were detained was made very clear. Of which was successful in locating illegal drugs on party goers at the time."

 

"As you understand. At the time we had an active scene with a lot of people involved. It is our responsibility to answer that situations like this are dealt with quickly and correctly therefore at the time questions were unable to be answered. As for the reasoning, as started, officers were alerted to narcotics on the premises. We had probable cause to conduct searches and when requested not only did we have people admit to not only taking narcotics."

 

For her closing words she issued a reassurance that "We never want to spoil anyone from enjoying themselves as long as it is safe and lawful."

SKJae: As the owner of that house, can confirm that the cops ignored any private property law. The Carl Winslow looking officer that showed up and asserted because it was "open to the public" that private property laws didn't apply to them and he could enter as he pleased. He later changed his story that he "received reports" but refused to provide any evidence of them even when requested at the front desk Mission Row by myself, the property owner. It was asserted to me that the officer had let himself in since nobody came to the door, at which time he observed copious amounts of marijuana and cocaine being used inside the house, that he entered illegally. It should be noted that no cocaine or marijuana was seized from the premises, and the house was not even searched for said contraband that was allegedly present. Classic jackboot tactics by a police force that has nothing better to do with its time.

Comment: I count 6 officers including a captain, and a k9. An excellent distribution of tax paid resources to deal with the truly dangerous threat that is marijuana (notice use, no mention of distribution). I wonder how many rapes and murders went unnoticed while the head of this cities police force was occupied, arresting a man for placing his arm round him.
