  1. Short description: Banning any characters under 16 for factions and 18 for non faction characters. Detailed description: After reading this thread: And having had several incidents in my time RPing of child RPers shooting people or trying to flirt with adults, I'm in the boat with those in the post, who think it should just be abolished, there's a reason GTA doesn't have kids in the game. As suggested in the thread, gang RPers should just age up to 16 and have it in their backstory that they have been with X gang since they were e.g. 12 if necessary. Edited to be under 16, not 18.
  2. "Poor escalation" is an extremely common phrase used on the server, mostly only used by someone in /b moments after they've been killed. In this thread, I want to instigate a discussion on what "poor escalation" actually is, what defines it, and why it's a thing. The server rules mentions nothing about escalation, with admins tending to refer to ROE when dealing with cases they class as poor escalation. ROE states that situations must escalate realistically and organically for them to be acceptable. The DM rules (4.0) state that you must have a valid (not a poor reason) to kill somebody. Firstly, I will give a personal experience I've had recently as a reference as to what the server classes as poor escalation. I say the server, as after a staff-report; staff management also agreed that my actions where indeed poor escalation. After a minor altercation at a skin-head bar in Vespucci, my character walked outside to be followed by two "Vespucci Skins" skinheads who where undoubtedly clearly skinheads and gang-affiliated. Whilst walking towards his brother's car, one of the skinheads call out to my character calling him a "faggot" and numerous other slurs. In an attempt to keep the peace, my character ignored them. As he carried on walking, another skinhead ran up behind my character and began to punch him with the emote "/me sneaks [character] from behind", easily assumable to be the instigation of a "rush" and not a singular punch. After getting run-up on and attacked, my character pulled out his pistol and shot the skinhead. A few hours later I was reported and subsequentially banned for DM and Poor Escalation. From this, you could assume that in order for self-defense to not be classed as poor escalation, the attacking party would have to show you an equal amount of threat as to what you return to them, much similar to "use of force doctrines" employed by law enforcement agencies. I.E in order to have the OOC right to shoot another player, they must have pulled a weapon on you. I personally think this is extremely stupid, it's a control over RP and puts every single character into the same box; which is extremely unrealistic and limiting to the player. How do you define poor escalation, what classes as poor escalation and what is an example of that? I think this is an important discussion.
  3. So we've had a few threads as of late that's just pooled into toxicity, arguments and whatnot. So here's my question! If you could add a rule to the server and remove one rule, what would it be? Also you gotta think up some cool name for it that doesn't sound weird. Remove: Mine would have to be Rule 12, Crime Free areas. People can get into trouble in a bank, in a police station, it doesn't really matter. I don't understand how there's some strange forcefield that stops criminal activity from occurring just because it is happening in a place surrounded by cameras. It should still happen but obviously the person doing it is gonna get caught. Add: I would name Rule 21 "Fighting Chance/Last Stand (or something cool idk)" which is basically a rule where if you are caught in a totally unwinnable situation such as trapped in a car with LSPD aiming guns at you, or you're caught in a situation where you're heavily outnumbered and you raise offensive action to stop the situation from happening? That's totally fine. But if you die? That's game over for the character you currently have. This is to stop people from deliberately getting into unwinnable situations, raising a gun to stop the consequences from happening such as prison, losing items, etc. Please don't let this thread go toxic.

  5. I am making this topic to start a discussion as it seems everyone isn't on the same page regarding melee fighting in-game. As you're quite aware, there's two types of melee fighting: script and RP. The former involves spamming LMB and manipulating desync in order to down your opponent and in my experience is widespread, with small weapons being asspulled (legitimately, as per the rules) and used to run up on foes. /mes are used but the knocking out is done scriptwise. The latter involves quite obviously /me and /do with time given to react and is used to create a scene rather than lay your opponents flat-out. In my personal experience, I have RPed fighting among friends and faction where I know they won't aim to drop me, but in the vast majority of situations against other players I have been on the giving and receiving end of the LMB spam attack and have had no complaints until now. I had a situation with @Chey and another player last night which prompted me to start this discussion as I believe everyone is not on the same page, which they really should be in order for a fair environment to flourish. I argued that script fighting is a valid route since it's scripted as a weapon just like a gun is - and that running away in itself is a roleplay reaction, and that literally everybody I've encountered engages in it judging from experiences derived from both my criminal character and gangster alt. Especially on my gangster alt where in Davis, Rancho, people frequently run up on you with ye olde spam! Chey argued that I should report whenever script fighting occurs in that sense as it's powergame. However, Chey's standard is visibly not in line with what I've predominantly encountered across the server. I had in fact never heard a complaint about it up until that moment which suggests to me the SAMP-imported behavior of scriptfighting - as opposed to fully RPing it out with zero scriptfighting as I used to on OwlGaming MTA - is somehow wrong etiquette which I share with the majority of the players I've encountered. Chey simply voided the situation on account of me knocking the other out via scriptfighting. I will attach the video here for reference to the type of fight that went down. No punishments were dished out. https://streamable.com/hoojlq Keep in mind that this situation is strictly for reference and the discussion is a general one. A few ideas to kickstart: Does the status quo of scriptfighting or perhaps other players' play to win mentalities necessitate scriptfighting as a legitimate means of attacking and defending from other players? It seems you're in a disadvantage if you get rushed on and don't attack defensively out of RP ideology. With regard to powergaming, "It is not allowed to force actions upon another player" - does the rushing of others with scripted weapons fall under this as the weapons are indeed scripted and they've even implemented a /helpup command and allowed the asspulling of melee weapons? The reason you don't have to /me pulling guns out is because the situation erupts too fast for you to realistically type out a /me to draw in comparison to the fraction of a second it would take you to draw said weapon, hence the exemption. Does the inclusion of melee weapons in this list imply that knives, knuckledusters are to be, or can be, used in a scriptwise manner? Is a 1v1, 2v1, different from say a group brawl in terms of rules? Should there be regulations to state this, for example the requirement of both parties agree OOCly in 1v1/2v1 to script fight in case one prefers RPly being beaten up? Is scriptfighting a legitimate attack or blatant PG? As I initially stated, I just want the community to share their own experiences with melee fighting and perhaps come to mutual agreement on proper etiquette as to me it's blatantly obvious that hasn't been established. According to Chey, scriptfighting, in its current widespread, is against the rules. However, the majority of you can see that this supposed rule is not enforced whatsoever. Discuss.
  6. Copyright Infringement & The Fight For Original Content. WHAT IS COPYRIGHT AND ITS INFRINGEMENT? Under the copyright law, the creator of the original expression in a work is its author. The author is also the owner of copyright unless there is a written agreement by which the author assigns the copyright to another person or entity, such as a publisher. Using content without permission or legal rights to it, in any way, is copyright infringement. Even if it is not monetized. As a general matter, copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner. This thread is not to discuss whether or not a group would/should contact for legal reasons, because we can all argue if that could occur or not for ages without any sort of outcome to this thread. WHERE IS THIS HAPPENING? With a dive into the forums, it seems as if plagiarism was previously a rule against the server as early as 2017-2018, and last seeing it in 2019. Below I’ve pulled up as many of the motorcycle club factions that I could find using copyrighted material from real life. This is being used on the forums, and in game. Currently it’s popular to have a client side mod between these factions that sport copyrighted logos on their back for ‘added realism’ and for screenshots. So the use goes across many fields. A C T I V E FACTIONS: -Mongols MC -Vagos MC C L O S E D FACTIONS: -Cossacks MC -Red Devils MC -Sons Of Silence MC P O T E N T A L FACTIONS: -Outlaws MC (Not an Official faction as of 3/AUG/2020) Use of these are not advancing understanding of political, human rights, economic, democracy, and social justice issues, etc. So this does not constitute under ‘fair use’. WHY WE SHOULD RESPECT THE LAW / MORAL GROUNDS. Most of us who research into the 1%er and outlaw club life know very well how disrespectful using their logo is. There is an entire brotherhood built upon the MC name and patch that takes effort and time to earn. Ethics wise, these logos are not ours to use or reproduce, especially when we are the ones who advertise the server to potential donors with such materials. Just in the past few years, the Hells Angels have brought more than a dozen cases in federal court, alleging infringement on apparel, jewelry, posters and... yo-yos. The group has also challenged Internet domain names and a Hollywood movie — all for borrowing the motorcycle club's name and insignias. Recently they have sued rapper Young Jeezy for his knock off apparel. Morals aside - and speaking in a more broad sense - I have concern for GTAW as a whole. Any actual people using these images, logos, materials could be at risk for DMCA / EUCD take down. The community acts as a singular unit, and while this is a platform - I’m not entirely clear who would be responsible if something such as this would happen. I feel as if it is paramount that Management would enforce a new Copyright and Plagiarism rule for the sake of protecting everyone, and themselves, from any potential legal jeopardy. Motorcycle clubs are worldwide, therefore, a lot of these copyrights are protected under international laws and treaties. Here are some examples of the Mother Chapters’ copyright info using such; MONGOLS Active Copyright. VAGOS Active Copyright. OUR CONFLICTING RULES. 6) Character Rules -Names cannot be famous or be similar to a famous person's name. -Names may not be the same as or similar to characters in video games, movies, TV shows or any other form of media. Not sure why names have been the extent of famous use. Businesses and Logos should be included. We aren’t allowed to use real life face claims on facebrowser, yet, most faction threads use pictures of actual gang members in their opening posts. WHAT THIS CAN CHANGE? -Having these real life factions in the game create previous and existing allies and enemies. Hindering IC relationships to blossom. -Factions use of “In real life, X is known to Y” as arguments for certain actions they perform. Your faction should be KNOWN for what they do - because they’ve actually done it. Not just referring back to the real life equivalent. -Using pre-existing turf outside of Los Santos as leverage for deals and actions. These MCs have their own turfs and allies that could cause issues if one would attack the other in LS - causing an entire worldwide war. -Promote more original content, original stories, original logos, original character development and goals. THE FIGHT FOR ORIGINAL CONTENT. Original content is one of the greatest things this server has. It backs up our claim for being strict and full of quality. To base and start off your faction from a Wikipedia article is a small amount of effort compared to those who have created their own logos, their own backstory, and did not use existing lore and grounded rules to their advantage. This type of groundwork for development is astounding. Plus, The sheer amount of quality control it would take to make sure everyone is properly conveying these real life clubs and gangs seems unfeasible. While this thread is to point out issues with copyright, I commend all of you who have worked tirelessly to produce your own original content, and only want to see more of it! CLOSING STATEMENTS. I understand that this thread could inevitably be populated with an army of faction members trying to defend their use, and I understand that this may feel like just pointing fingers. I hope that the hours I have put into writing this statement proves to you that there is no personal ill will, but instead a push forward to make our server fair, right, and better for everyone. For the argument that this is simply a game server. Regardless of the purpose of any content or its intended use, there is still an end product and these images are being misused.
  7. Is kidnapping someone for money allowed? And would it fall under the $5000 robberies rule or the $75000 scams rule if you called their friends to get ransom money?

I know this has been discussed at length in other threads, but what I'm trying to do here is come up with a legitimate system that ends with a compromise regarding PK's and value of a person's life. A player's value of their own life doesn't seem to have any sort of bearing on behavior in most illegal RP when you look at situations with gun fights, gang disputes, shootouts with Police, evasions, driving recklessly, etc. Why? The end result is a PK that is ultimately temporary and players OOC are aware they will just be able to /acceptdeath and start right back up again with zero consequence besides losing their items. So, in a gang shootout, players have no real value of life because a PK is just a PK. They forget it ever happened and go on about their day. Now just to note, I am not in support of getting rid of PK's in favor of CK's. I believe both of these tools have their uses in a role play server and as such function well here (CK application notably). I don't feel this server is hardcore enough to warrant just using a CK system. I do believe that there should be a split in the PK rules to allow for a "Value of Life" addition which compromises with both legal and illegal role players. The current rules discuss role playing fear, but they don't specify that there should be a value for one's life requirement. Here's where I'm going with this: Scenario A: I'm an innocent bystander riding my bike through gang territory. A gang shootout happens and I end up getting killed in the crossfire. Nothing really happens besides items lost. This is not a situation where fear RP occurred because it was basically collateral damage. This is a standard PK, through which current rules apply just fine. Scenario B: I am a gang member who has initiated the shootout in Scenario A. I have pulled my weapon and started shooting at other gang members over a territorial/gang dispute. Other gang members in turn, start pulling their weapons and shooting back rather than running for cover in fear of losing their lives. At this point, these players have disregarded a value of life rule in favor of engaging in a shootout rather than running for cover and getting away from imminent danger. Scenario B is where I'd like modified PK rules put in place for violation of a value of life rule. People could argue that shooting back was for the reason of fear for their lives, but I could argue that running for cover and preserving their lives would be the appropriate reaction if they didn't want to die. Choosing to engage in the shootout is a blatant disregard for their lives. I believe a PK is still the right thing to do, but I think there should be more harsh consequences involved for this specific scenario where there was a disregard for value of life. Here is where I feel there should be a middle ground compromise between a normal PK (server desync, bug, error, accidental shooting, & a number of other situations) versus a PK that involves a disregard for value of life. What those consequences are? I'm not quite sure. That's why I want a discussion about it. I believe there should be way more thought put into one's actions before deciding to act in a manner that would jeopardize their life. The "Value of Life" rule should specifically state that one should always value their life and if that value is disregarded, harsher punishments should be put into place. Discuss.
