  1. Shooting at AURA Nightclub: A Retelling Akari, Co-Founder Kaizen Corporation Earlier tonight, a shooting occurred out front of AURA Nightclub in south Los Santos. The owner and manager, Ashley Hendricks, has been under fire for several hours due to her handling of the situation - specifically, continuing to run advertisements for the venue whilst the victim, a female, lay deceased in the building’s parking lot for an extended period of time after the incident. One account, lovingly named Trashley Hendricks, along with another Facebrowser user, Steven Keo, both posted images of the body after the incident. For the sake of privacy and respect for the victim, I've blurred out the contents of the images posted. After several posts criticizing both Hendricks for continuing to advertise, and the two Facebrowser users for posting images of the body, Ashley Hendricks herself makes a statement. After receiving backlash for her behaviour and false claims, she disables comments on the post. At the same time, user Trashley Hendricks brings to attention the fact she has not offered any public condolences to the victim whatsoever. Hendricks not only re-enables her comments, but also edits the post to include a condolence. Meanwhile, I’ve gathered a few recounts of the incident from several sources (some shown below among others), some who wish to stay anonymous. After piecing them together and ensuring they all match up, I’ve reconstructed a timeline of how the situation unfolded; Two men, one in a van and another in a car following behind, stopped behind the club. One was wearing a white hoodie. A girl was in the parking lot on her phone. The two men approached her and grabbed her. As she screamed for help, it caused a commotion. Meanwhile, a cruiser with two officers was performing a routine traffic stop on two women further down the parking lot. People began to gather around the scene. An Executive Security employee, a male, came forward and attempted to stop the man in the white hoodie from harassing the girl. The man harassing the girl then pulled out a gun. It’s unclear when the second man pulled his weapon or which man was holding which firearm, but we’ve received word that one had a pistol while the other had a submachine gun. One man ran to get the cops performing the traffic stop further down the parking lot - as he did, the men opened fire. We’ve received no word that the security guard was injured, but the girl they were attempting to abduct was shot several times. Her body was left laying in the parking lot for quite some time after the shooting. The men took off, police following. One witness, Zylas McDee, claims he was ushered inside AURA Nightclub by a second Executive employee - red hair, in a black cap. The male employee radioed in to the club, telling them there’s been a shooting outside and to lock the doors. McDee said as he was taken into the club for safety, he witnessed Ashley Hendricks attempting to come outside. She was blocked by the same female guard that brought McDee inside, though. Paramedics eventually arrived onscene and declared the victim DOA. During the time of these incidents, it’s confirmed that ads for AURA Nightclub were still running, despite the recent shooting outside and the male guard telling the club’s staff inside to lock the doors. This recount of the situation directly implies that Hendricks was lying in her statement on Facebrowser, regarding not knowing about the situation. Not only was the incident all over social media, both with ridicule and actual photos, but Executive Security staff working at AURA Nightclub radioed in the situation directly after it happened, and Hendricks was soon seen actively attempting to exit the building into the parking lot. Hendricks was 100% aware of the situation that was going on outside - she chose to ignore it in favor of her own capital. Even when security asked her to lock the doors and keep those inside safe, she continued to aggressively advertise the venue and bring more customers in. With all of this taken into account, it is clear and evident that Hendricks’ thirst for profit comes with no regard for morality or the safety of those she capitalizes off of.

  2. By: Anthony BoyceDate: 8/12/2019 Vespucci, the jewel of Los Santos tourism, when you ride through the neighborhood you expect to see a bunch of naked ladies, skaters, surfers hitting the waves, stoners smoking weed in a Volkswagen hippie van, however, the area has a very dark history regarding narcotics, racial slurs and a lot of hate crimes. An ex-PENI (Public Enemy No.1) member, named Needle, decided to do an interview with us today, answering many of our questions regarding white supremacy in Vespucci, and the city of Los Santos, alongside what it's like for a whiteboy to roll up in Bolingbroke or any correctional facility in the state of San Andreas. "Hey, what's up Needle, so our first question for you is, what made you make the choice of joining a white supremacist gang?" Needle - Hey, first I want to thank you for having me on the show, and ugh. It's kind of confusing man, you know what I mean? It's the same with drugs, really you're kind of forced into it. When I was kid my mom was a fiend, so it was difficult for me. My parents divorced when I was like ten, so I was able to see my dad only twice a month, he was actually in a motorcycle club, Vagos Emm-Cee, which also changed my state of mind, whenever I had to go to his spot I would see at least two Vagos inside and there would be dope on the table or a firearm, he never really bothered to hide the truth from me, I knew it since day one that he was living that lifestyle, the last memory of my dad was actually when I was twelve, he was sleeping on the couch and at five-thirty Ayy-Emm you hear somebody knock on the door, five times, BAM-BAM. Next thing you know, both doors, the front door and the back door get booted, masked guys with AR-15s and laser sights pointed at your face, breaching through the windows, shouting "GET ON THE FUCKING FLOOR, NOW!". Turned out that the Ayy-Tee-Eff was on his ass and they got a few his buddies locked up too, forty-three years in Bolingbroke for possesions of two ounces of heroin, they found two firearms in his garage and half a kilo of crystal methamine in his car's trunk. It was rough for me so I had to now live with my auntie, she was probably the only normal person in my family, a religious person she was. Anyways the whole process of me joining the 'white supremacist' gang was during my junior years at high school, I used to attend Vespucci Beach High School, and for those who think that it was a white boy school, you're fucking wrong! The majority were black, it was a Crip school, and the whiteboys were usually the victims, we were the minority so you were forced into either being a bitch or fighting for your own. But I remember one day, I was walking back from school, I never took the bus since the black kids would scream and shout and it was piss-taking, so I was walking home, right? I see these four kids, crips, asking me where I'm from, eventually the conversation escalated and one of them decided to swing, four on one, I knew what was going to happen, but somehow a six foot two, big guy probably hooked on meth, with a swassie on his neck and filled SS bolts on his stomach marched towards them and basically beat the living shit out of them **laughs out**. He asked me if I was alright and all of that crap, he then told me that he and his friends were kicking it a few blocks away, I knew most of the guys but I never got involved with them. With time I started to get accepted into the group, and it was sort of an escape from reality for me, I found shelter. I would usually go and buy dope from them since at the time it was all about dope n the punk scene, sooner or later I was doing dope with them. When I ran out of cash to get dope, I would go steal some, so I can sell it and get hooked up on dope again, nahmean? I was an anti-social weird fucking guy who liked to do drugs and surf, that was about it, it's a cycle that doesn't stop and it won't stop, when there's poverty there will be crime, and when there's crime there will be segregation and racism, and what gives birth to these white supremacy gangs, is racism and hatred, no way around it omey. "So, Needle, you mentioned that the cycle won't stop? So, me and the viewers are wondering, are these organizations purely based around a far-right fascist ideology that promotes racism and hatred, or there's a deeper meaning into joining a gang such as the Vespucci Beach Skinheads?" Needle - Now, this might sound weird, but most of us don't give a fuck about somebody's race. We just want to get hooked on something and get some money, most of my homies are money-driven, I've been in the game for thirty years man, I served half my life in prison, at this point I don't give a fuck about the skin color, at the end of the day, green runs the world. What starts the racism is the prison system, the penitentiary. It's been like that for the past sixty-seventy years, the whole movement started around the fifties and the sixties. The so-called Aryan Brotherhood used to go by as the Blue Birds. The caucasian race was always the minority in prison so they were forced into segregating themselves from the Mexicans and the Blacks. Since they had the numbers, and we didn't. But, I've met dudes that never banged, that were never involved in the whole white supremacy movement, but they were white so they were forced into adapting to that lifestyle of segregation and hate. When you go to the pen, you come out a different person. I went in on heroin charges, I was shooting dope for a few years and I got caught dealing, so I was sent to Cee-Jay (Needle pronounces County Jail as Cee-Jayy). A few months later I was sent to the level three-yard, Bolingbroke. I saw what was happening, I didn't want to live that lifestyle so I turned to God for guidance, and I came out clean, man. I've been clean off dope, heroin, coke - anything for like... seven years now. But, going back to your question - no. It's not about the ideology, you do have neo-nazi dudes, but most of us are in the game for the money. "Alright, alright. So, a lot of people say that a Peckerwood is the same thing as a Skinhead, is there really a difference between a skinhead and a 'wood'." Needle - Ye, there's a massive difference between a Peckerwood and a Skinhead. It's two different cultures, a peckerwood can be anything from a normal guy hitting the pen for a small charge, being forced to kick it with the whites, to being a gangbanger from a Hispanic neighborhood, but you're white. Matter'a'fact most of the peckerwoods, or so-called, woods act, speak and relate to the southern Mexican culture, it's heavily embraced by it. Most of the time you would see a whiteboy that claims to be a peckerwood, dress like a cholo. Where being a skinhead is a whole new thing, you've different types of skinheads, political skinheads and what the fuck not. The term skinhead actually came from England in the eighties, it was a working-class individual - civilian, that listened to punk-rock music. But, no. It's not the same thing, it's two different cultures. You've skinheads like Blood n Honour, Hammerskins, or Volksfront, they all look down on alcohol, narcotics sort of like the Aryan Nations, where Peeneye (PENI, Public Enemy No1), embraces it, that's our way of living, meth, meth and fuckin meth. So you have the money-driven skinheads that embrace the usage of narcotics and commit crimes, and then you have the political skinheads that look down on shit like that and are more politically focused. "Can you tell us, the viewers, how it feels like to be a white supremacist - a skinhead, in prison? Is there that sense of paranoia and danger twenty-four-seven, or?" Needle - Paranoia is usually what gets you killed. I started off as a Vespucci Skinhead and I eventually could call myself a Peeneye skin (Needle pronounces PENI as Peeneye, standing for Public Enemy No1, one of the dominating white supremacist criminal organizations in the San Andreas prison system). I mean, most of the time you don't get whacked by a black, or a northern Hispanic, or even the homeys (refers to the Southern Hispanic inmates, Sureños, as the homies) - you get whacked by your OWN. The white car, Enn-Ell-Arr (NLR - Nazi Lowriders), Peeneye, you can get whacked by any white for violating any rule, that can be from speaking to a black to selling dope to a Norteño. The more you progress through the chain, the hierarchy the more dangerous it gets, motherfuckers plot on you, they want to see you dead, nahmean? You go in as a fresh-meat you and come out a shark, man. IF you're on that one yard, where it pops off whenever your cell door opens, it changes you - it breaks you. A lot of motherfuckers can't handle the heat so they get rolled up and they get sent to Pee-Cee (PC, also known as, Protective custody). We're pretty similar to the Southsiders. We're really organized and we answer provocation quick and hard. "So, Needle, earlier you mentioned white supremacist tattoos, can you tell us what they stand for, and the meaning behind them?" Needle - So, there're the filled SS bolts, that stand for stabbing a minority, such as a black. Then you have the Pee-Dee-Ess, which stands for Peeneye Death Squad, then you have the cobweb which stands for prison time, and there's the clock with broken hands which also stands for prison time, but we're talking about a longtimer, shit like fifty years in the pen. Every single race have their own type of tattoos, the homeys (Sureños), have that funky style mixed with the Aztecs, so you've Cholas, Chicanos, Aztec warriors - all of that shit mixed together, where the whites, we have that medieval style, mixed with of course the racist tattoos.

  5. "Mafia is a process, not a thing. Mafia is a form of clan-cooperation to which its individual members pledge lifelong loyalty. Friendship, connections, family ties, trust, loyalty and obedience -- this was the glue that held us together." - Joseph Bonanno The Conti crime family, sometimes referred to as the Los Santos crime family can trace its roots back to the Clinton Avenue Crew. The organization became prominent in late 2017 as a San Andreas-based satellite crew for the Kansas City mob, the Civella crime family. As the Clinton Avenue crew grew in numbers and developed more autonomy, it was referred to as the Los Santos crime family. With this new title, not only did the organization become a significant player, but it also began to catch the attention of various law enforcement agencies. As the Kansas City old guard began to catch more heat from federal law enforcement entities, it was clear that someone would go down. The foreshadowing all came true after Roy Capra's arrest a few weeks after Peter Conti and Thomas Alo's induction into the Los Santos crime family. Following Roy Capra's arrest, the remaining members of the Los Santos crime family would fall off the grid leaving only Peter Conti to operate within Los Santos. Rise Of Peter Conti After months of expanding his power base and his crew's influence, Peter Conti soon had to solidify his position and his crew by eliminating the threats to his new regime. Thomas "Verbatim" Alo, another LSCF captain, resurfaced and was found gunned down a few weeks after returning to the city. Peter Conti sent his associates, Dominic "Ted Bundy" Altomare and Daniel "Pretty Boy" Santoro, to eliminate James Padanova, a suspected informant. Following Peter Conti's regime's growth and expanse was a period of peace; Conti utilized the connections and resources of his soldiers further to strengthen his grasp upon Los Santos' criminal underworld. Through illicit trade, as one of Conti's soldiers, Joseph Campagna, has been said to have been a significant player in Los Santos' drug trade, having pumped an abundant amount of narcotics such as cocaine, heroin, and ecstasy into the market. Following the deaths of Alo and Padanova and the inductions of Joseph Campagna, then later, Dominic Altomare were made members of the family. Los Santos had all but formally cut off its ties with Kansas City. Lacking Kansas City's support, Conti and his people soon saw the city return to being free for all between various crime families through their satellite crews. It would be the beginning of the first "war" for supremacy. Wild Wild West Two long-term associates, Henry "Hairpiece" D'Amico and Daniel "Pretty Boy" Santoro, were inducted as made men and given the task to handle the encroaching crews through elimination or subjugation. After a few months of the conflict, the duo completed their job through the Vespucci Beach-based Lagrusa crew's subjugation. A few weeks after, word went around that the remaining members had all left the state. With contending crews being taken care of, the term Conti crime family began coming into play in some circles. Meanwhile, back in Kansas City, the group would still be referred to as ingrates and pretenders. With the new name, however, the organization saw an increase of influence throughout the state as it enjoyed a time of growth. Conti Golden Age As the organization grew, upper management opened the books for a long-term associate of Peter Conti's, Gerald Marchetti. His induction into the ranks led to the first crews being established within the family. With Daniel Santoro and Gerald Marchetti both at the reigns of their respective crews, the crime family's reach began to creep into all aspects of Los Santos through the procurement of government contracts and control over the drug flow into the city. Under Dominic Altomare's direction, Daniel Santoro and David Pillini were often sent out to deal with other organizations in the town, the trio preferring to have business partners instead of rivals. This doctrine was enforced by the upper echelon even further as David Pillini was sent out of state alongside John Carrone and Donald Birchese to strengthen business relationships with organizations throughout the United States' sunbelt region. A Few Bad Months What was referred to as the "Golden Age" continued as Carmine "The Weasel" Gallo, Nicholas Trisano, and John "Tuna" Capra were brought in as made men. This making ceremony would have been the beginning of the end; however, long-term associate and prospective member Marco Caruso was stabbed to death weeks later. However, after a period of internal conflict, Carmine Gallo would be the only one of the three left alive. After the death of two members and a handful of associates, the organization began to pull the San Andreas Bureau of Investigation's attention. SABI, relentless in its efforts to arrest the Conti crime family's leadership, put the organization into a mothballed state as members went off the grid to avoid investigation. The SABI probe would have been the first time a State or Federal agency launched a long-term investigation into the family directly instead of one of the schemes they were involved in through proxies. The Renaissance After a few months going from city to city throughout the South-West, Conti associate and prospective member David Pillini was called back to Los Santos by Dominic Altomare. With his return also came the return of the organization's prominence within the criminal underworld in a few weeks. Associates of the Conti crime family such as James Granillo, Michael Farina, Hugh Calilri, and made members like Carmine Gallo and Daniel Santoro would be critical for their new criminal schemes. Once again, the crime family in a position of power soon opened its books and inducted James Donnelli, Lawrence Zampa, James Granillo, and David Pillini in as made men. While each of these men took care of their duties, more prospective members such as Michael Farina, Hugh Caliri, Ricky Castellani, and Brandon Falasco saw themselves being brought in as made members as well. In Conti fashion, the newly made individuals were constantly sent out to deal with external problems. In this case, David Pillini, Hugh Caliri, Ricky Castellani, and James Granillo were used to stamp out the competition on the west side of the city and return the family to its powerhouse status. Cutthroat Politics As Dominic Altomare oversaw the family's return to the top in the criminal underworld, Peter Conti continued to see that his influence was everywhere within the city's government. During the mayoral elections of 2020, the Halford campaign saw itself bankrolled by Peter Conti to gain control over the mayor upon his victory. However, this dream was short-lived as, after a few weeks in office, Halford turned on Conti by outing him publicly for attempting to bribe him. Oswald Halford ousted Peter to distance himself from the crime boss but was met with proof of his corrupt actions surfacing. Halford was promptly arrested for perjury; Peter Conti cooperated with the district attorney's office to avoid Oswald's allegations. After being exposed during the Oswald Halford corruption scandal, Peter Conti fell off the grid, leaving the family had to deal with the spotlight being shined on Vinewood. With Peter Conti gone, it was only natural for underboss Dominic Altomare to take the helm. Spreading the Gospel Under Dominic Altomare's leadership, he brought the family's old priorities back to the forefront of criminal doctrine. After an internal reorganization, Gerald Marchetti and James Donnelli joined Dominic Altomare within the upper echelon. Carmine Gallo and James Granillo, the two newly appointed captains, continued to oversee most day-to-day business as the organization's influence began to grow once more. Paul Martino's induction only continued to bolster the ranks of the made members within the crime family. Alongside Paul Martino's making came a return to the control of drugs following into the city through David Pillini's out-of-state connections. With the grasp of product flowing into the city, old alliances with organizations throughout the state were rekindled. The crime family also forged new partnerships through the distribution of narcotics and firearms throughout the state. As the criminal underworld within San Andreas continues to house multiple wars between different organizations throughout the city, the one bulwark that seems to be unconquerable remains on Clinton Avenue in Vinewood. OOC Information The Conti crime family reserves the right to permanently kill any aspiring members if necessary. Permission to post screenshots must be given by an inducted member. 6. DISCLAIMER. This is general legal information. The law of contracts and other areas that are related to auctions is in its infancy and largely underdeveloped in San Andreas. You may rely on the information to decide whether to seek specific legal advice from a bar practitioner; but you must not rely on this general advice otherwise. Your situation must be examined independently and for that you are encouraged to seek legal advice specific to your situation. This advice is general and not suitable for use in court. You have been warned. If you proceed further, you agree to release the Foundation for Law and Government (FLAG) and its contributors from any liability arising from the use of this general advice. "Auction" = a sale by competitive bidding. "Auctioneer" = someone who sells something on behalf of another (the seller) by competitive bidding. "Agent" = same as auctioneer, but it can also be a representative who makes a purchase on behalf of a buyer. "Principal" = the seller who retained the auctioneer, or the buyer who appointed a representative. GENERAL TIPS AND ADVICE FOR BUYERS How does an auction work legally? In an auction, like all contracts, the transaction happens like so: offer + acceptance + consideration + performance. An offer is made and communicated; the acceptance is then communicated as well. Once accepted, in the context of an auction, the accepted offer creates a binding contract and there is performance by deliverance of the property. The consideration, in the context of an auction, is the payment of an agreed amount in exchange for the property; this is typically paid out before delivery. What is an offer in the context of auctions? In answering this question, it is helpful to remind that a seller’s (or auctioneer’s) advertisement of a starting bid is not an offer. It is only an invitation. It is, thus, not amenable to be accepted. The offer is the buyer’s bid, which the auctioneer or seller accepts by communicating the acceptance (as seen below) When is a contract formed? In basic terms, the contract is formed once the seller (or the auctioneer acting on behalf of a seller) accepts a buyer’s offer. In a formal auction, this is occurs when the hammer falls. However, on the online marketplace, it is when the seller or auctioneer communicates the acceptance to you -- it can be online or by any other reasonable means. There are rules for communication of the acceptance. Can the seller or auctioneer use friends or associates to prop-up the price? No. Again, because San Andrean law is underdeveloped, the “no” is actually less definitive than it sounds. Generally, however, the law will only give effect to legitimate bids. So, neither the seller nor the auctioneer may invite illegitimate bidders to boost the price. This is complicated and tends to be difficult to prove. A seller may, according to the law of restitution, may be liable to a reversal of his/her gain even if he or she is unaware of the auctioneer’s misconduct in injecting illegitimate bidders. The standard which the court will try to arrive at is ‘fair market price;’ this will be used to calculate the amount of the restitution to be paid. Because this is a complex area of law, you are encouraged to seek legal advice if you suspect it applies to your situation. Can the seller or auctioneer withdraw from the sale after he or she has accepted? What happens if it is withdrawn? No. The seller’s advertised sale can only be withdrawn before the communication of the acceptance of your offer; once it is accepted, it cannot be withdrawn. Similarly, you (as the buyer) can withdraw your offer at any time before the auctioneer or seller accepts it. If it is withdrawn after acceptance, you may have a claim for breach of contract. You can, among other things, ask the court to order the auctioneer to perform the sale. If it would be impossible to perform the sale at no fault of either party, the seller or auctioneer may have a defence called “frustration;” in which case the court would resolve that the contract is frustrated and release both sides from it. Failing to meet an expected number of bidders will probably not suffice to frustrate the contract. If performance is impossible at the fault of the seller or auctioneer, then a breach is likely and the court will consider other damages, such as loss of chance. Damages is a significant area of law. For this reason, you are encouraged to seek legal advice on damages. If the sale is withdrawn before the acceptance, then nothing of legal significance occurs because there is no contract without communication of the acceptance. So, the seller or auctioneer can withdraw the sale so that he/she may arrange for another auction or to sell an individual who is not a participant in the auction, but only if your offer was not accepted. What happens if someone tries to auction something which he or she does not own, and I paid only to find out that it was not his/hers or that he/she was not authorized to sell by the owner? The actual owner may bring a complaint for what is called “conversion”; as for you, you may bring a complaint against the auctioneer/agent under contract law for misrepresentation; i.e. that the auctioneer misrepresented either having good title, ownership or authority to sell. This type of misrepresentation is consent-vitiating; this means it is capable of “erasing” your consent to the trade. What if the seller or auctioneer has sold me something not as advertised? This is, generally, a misrepresentation. If the seller misrepresented the nature of the thing which he puts for sale or authorizes an auctioneer to put for sale, then you may have a claim against the seller; but if the auctioneer mistakenly misrepresents what the seller has told him, it is unclear if the seller is also liable for misrepresentation. In any event, you may have a claim for negligent misstatement against the auctioneer. The negligence claim, however, is under the law of torts and not contracts, so the court won’t void the transaction; for this, you would need to claim consent-vitiating misrepresentation against the auctioneer if the seller is unknown, or against the seller if known. For the negligence claim, the question of what damages (or relief) is available to you can be complicated. You are encouraged to seek legal advice regarding damages for a claim in negligence against the auctioneer. Can a seller or auctioneer sue me (a buyer)? Of course. They can, among other things, sue if you make an offer, which they accept, and then you refuse to follow through. Only submit a bid if you are prepared to follow through with it after you receive communication of the acceptance. Can an auctioneer act for a seller who remains anonymous, and not tell me who the seller is? What if I want to sue? Yes. As with every other question, there is no law in San Andreas on this question, but the general position across Anglo-American jurisdictions is that the seller need not be disclosed. However, if the auctioneer does not disclose who the seller is, he/she is personally liable even for breaches which are typically attributed to the seller. The reason is that it is assumed that a buyer will not contract with someone who is unknown (or anonymous) unless the auctioneer acting on behalf of that unknown seller makes himself or herself personally liable. So, for example, if an anonymous seller makes a misrepresentation and conveys this to an oblivious auctioneer, normally you would have a claim against the seller; but if the auctioneer does not disclose the seller’s identity, your complaint is against the auctioneer who must accept being liable. If a seller insists on being an anonymous and the auctioneer does not want to accept the legal consequence of the seller’s anonymity, the auctioneer can refuse to provide his service to the seller. Any auctioneer who gives effect to anonymity must be prepared to accept liability for a seller in breach of contract. Can an auctioneer charge the buyer extra to make a profit from the sale? No, but as a buyer, it is unclear whether you can recover. Typically, this is an issue affecting the principal (the seller) who hired or retained the auctioneer. Under the law of fiduciaries (trust), because an agent (auctioneer) holds the property of the seller in trust, any money which he/she generates is also held in trust and must be given to the seller/principal; so even if the auctioneer were able to generate five times over the starting bid on the sale, no amount of that can be withheld by the auctioneer as commission or a profit. Only where the principal (seller) has consented to paying a commission can the auctioneer make a profit. An auctioneer should not be charging you (the buyer) a fee as commission on top of the agreed price. ADVICE FOR SELLERS Do I have to use an agent/auctioneer? No. You can sell your own property by auctioning it yourself. You are not required to hire or retain an auctioneer. However, all the usual formalities of contract still apply even where you sell directly instead of through an agent or auctioneer. If I use an auctioneer, how do I guarantee that they will act in good faith and not rip me off? First, auctioneers owe you what are called fiduciaries duties. They include a duty to account (account for any money they receive and produce it at your request); duty to avoid a conflict of interest created by bidding for a buyer; and duty to avoid a conflict of interest created by purchasing the property for himself or herself. If these duties are breached, you may have grounds to bring a complaint. You are encouraged to seek legal advice if you suspect an auctioneer was in breach of any of those duties. Second, find an auctioneer you can trust. Also, if he/she causes a loss from the sale owing to some lack of competency and/or knowledge, or if she/she makes a misstatement as to the condition of the property put for sale, you may be able to recover. You should seek legal advice if you suspect an auctioneer’s performance fell below the standard of the ordinary competency of an auctioneer. How do I make sure the auctioneer does not sell below the amount for which I’m willing to sell? Use a reserve price (this is not the same as a “starting bid;” a starting bid is the minimum bidders must offer, but a reserve price is the minimum which you as a seller are willing to accept). While an auctioneer whom you have authorized has implied authority to accept offers and take payments on your behalf, they do not have the authority to sell below a reserve price. Are there any special rules for authorizing an auctioneer when I hire/retain one? No. A lot of the authority of an auctioneer is implied, but if there are particular things unique to your arrangement, such as paying a percentage of the proceeds as profit or commission, those should be documented in writing. You should also document if there is a reserve price. ADVICE FOR AGENTS AND AUCTIONEERS The seller and I did not agree on a commission before undertaking the sale, but I spent my own money to make the sale happen (e.g. purchased upgrades, or another e.g., incurred expenses such as gas); is there anything I can do? Yes. You should first try to resolve this without a complaint; ask if the seller is willing to pay you. However, you may have a claim in restitution by way of unjust enrichment. This is a complicated area and you are encouraged to seek legal advice in this area before pursuing a complaint. The seller and I agreed on a commission or remuneration, but the seller has not yet paid me; what can I do other than go to court? If you have not been paid, you may withhold any property or payments in your possession until the seller has paid you. This is called a lien and is permissible at law. A lien attaches to the money you receive from a buyer; you are entitled to withhold it until you are paid. If you have already given the seller their money generated from the sale, of course this becomes difficult if not impossible; but if you did not make an agreement to be paid, you do not have a lien and withholding the seller's money puts you in breach of a fiduciary duty (a civil issue) and could see you with a charge for theft (criminal issue). You can always consult a lawyer before withholding money to make sure you have a lien. AGREEMENTS IN GENERAL A prospective buyer made an offer by e-mail and sent me the terms of their purchase; I subsequently replied to accept and asked the buyer / offeror if they had someone to draft a document. They relied “No need; our e-mail is proof of the existence of an agreement.” Is this true? Yes. A written agreement is one which has permanency. Permanency is what distinguishes an oral agreement from a written agreement. Because an e-mail has permanency, unlike a verbal exchange, it is binding as long as there was an objective intention to enter into legal relations / create enforceable obligations. Agreements can even be written on napkins and greeting cards! A more common example is a receipt slip for proof of purchase; these receipts are proof of an agreement (an agreement for the sale of goods or a service). You do not need a specially-formatted document — a receipt printed in any format, or e-mail containing terms laid out in any manner, will be binding if there was an intention to enter into legal relations. For this reason, if you seriously intend to make a property sale, make sure you do not communicate anything by e-mail which you don’t intend to be binding. IMPORTANT This general legal information will periodically change. There will be updates to this after the enactment of new formalities or after relevant judicial rulings. Reforms should be expected soon, but not often.

  7. Feature Showcase - Los Santos County Sheriff & Jail Showcase Overview The Los Santos County Sheriff's Department faction, in conjunction with the DoJ, LSPD, Faction Management Team & Mapper Team are proud to announce a rejuvenation of the server's Criminal Justice dynamic with both criminals & Law Enforcement alike. The upcoming update brings forth a host of new changes regarding the Judicial System & Law Enforcement process. Criminal roleplayers within the server will now face physical penalties for their actions, as well as pre-trial detention depending on particular circumstances. Law Enforcement Officers will now have to in-process arrestees at the newly-mapped Los Santos County Jail, operated by the Sheriff's Department. Commands /releaseme - Exit the jail permanently after your time is up /jailtime - Check how long remains before you can be free'd /jrequest - Request a deputy if any is available, offline guards will be notified on Discord through an IC notification channel /cellinfo - Prints information about the cell /jevent - Report an event to the guards, for example : /jevent You would notice a body left in a blood pool in front of cell A001. Guards will receive the event on Discord to notify them OOCly about the event that they would discover ingame. /onduty - Check how many guards are online /jlockdown - Open / close all doors of the current interior you're inside (guards only) /assigncell - Change the cell of an inmate (guards only) /release - Releases an inmate (guards only) /checktime - Check how long an inmate is jailed for (guards only) /showwristband - Show your wristband information to another player /setjailstatus - Set a special status written on the prisoner's wristband (guards only) Jail time will decrease 3x faster if you actively roleplay (This current value is temporary and might be modified in the future) How Arrest Works Former System: Arrest > Temporary Detention at Police Headquarters > Potential Court Case or Release New System: Investigation > Warrant > Arrest(starts with arrest if 'on-view') > Booking at County Jail > Detention > Bond Hearing > Due Process > Release or Sentencing/Conviction Expected features of the jail The Los Santos County Jail will provide an interesting roleplay dynamic for both Government & Criminal Roleplay. The circumstances of the jail allow for criminal gangs to manifest within the incarceration system, as sentenced inmates will be assigned to the jail to interact with pre-trial detainees. Features in development include: Bond System - allowing inmates to place surety/collateral to bonding companies in exchange for release from the county jail, on grounds they may loose assets or finances if they do not show up for court. Commissary / 'Books' - this serves as a means of both sustenance and institutional currency for inmates within the county jail. [In development] Weapon features - inmates are able to fashion weapons from items they find or create, to include shanks. Booking - inmates will have their arrest record & incarceration status on-file with server Law Enforcement entities. Conviction / Sentencing - inmates facing sentences may be assigned to the county jail for long durations of time. 'Prison Gangs' - long term inmates may be able to create gangs 'within the walls'. Phone System - inmates will be able to place calls from the jail. [In development] Other features to come. Full album : https://imgur.com/a/zSH60EK Additional Information Judicial Faction Los Santos County Sheriff's Department Special thanks to the Mapping Team for the hours and hours of hard work that they have dedicated to this. Not only in building, but research, discussion and reworking when it became apparent mid-mapping that things were not going to work as the floor plans dictated. As a server we are lucky to have people who will selflessly give up their own time to provide interesting and immersive features, from the Mapping Team right up to the administration team, past and present, who have worked to make this project what it is. Looking forward to our next grouping of projects, and working to manage such an amazing group of people.

  9. EAST SIDE BOUNTY HUNTERS - DAVIS By: Anthony BoyceDate: 8/12/2019 The East Side Bounty Hunters are a predominately African-American street gang located in the Nickerson Gardens public housing projects in South Central in the City of Los Santos. Prior to the formation of the Bounty Hunters, the main group in this area was known as the Green Jackets led by Rhea (Ray) Boyce which actually extended into the Jordan Downs projects where Al Pygmy was one of the leaders of the Green Jackets in the Jordan Downs projects. The Bounty Hunters started around 1971 and many attribute Gary Baker and Junior Thomas (1954 – 2017) as being very influential figures during Bounty Hunter’s beginnings which formed off 112th Street in the projects. The Bell Haven Bounty Hunters formed around 1978 to the west of Central Avenue just south of the train tracks and then around 1981, Renee McGowen began the Lot Bounty Hunters. The Bounty Hunters eventually formed a lot of subsets, such as the; Lot Boys, Block Boys, Bell Haven, Ace Line on 111th Street, Deuce Line on Grove Street (Original Block), and many more. Their main rival would be the Grape Street Watts in the Jordan Downs Housing Projects but since 1992 there has a truce between them and the other gangs in Davis. Although the truce has been in effect for some time, there are occasional problems between the Crips and Bloods in Davis, but not like had occurred during the 1980s and early 1990s. During the early 1970s, the Grove Street and Covenant Avenue housing projects were united as the Green Jackets and there were no Crips in Davis. Eventually, the Jordan Downs became Crips, the Bounty Hunter became Bloods and conflict between the two sets erupted. Michael “Harry O” Harris is from this neighborhood and he produced a play in 1987 called “Checkmates” that starred Denzel Washington and was considered the financial muscle behind the formation of Death Row records while he was in prison. Harris was convicted of the kidnapping and attempted murder in 1987 and is currently serving 28 years in the Bolingbroke State prison. Although Mike Conception claimed Crip, much of his family were Bloods from this neighborhood and he was born in South Los Santos. Conception was a serious hustler and pimp that was paralyzed during a dice game when he was 21, but he got into the music producing business during the mid 1980s and has worked with many influential music industry artists alongside others groups when he produced the popular west coast version of “Self Destruction” called, “We’re All in the Same Gang” in 1989. He did an interview in the 1999 F.E.D.S. Magazine (Vol.2, Issue #6) and he appeared in the 2004 F.E.D.S. DVD about LS gang history. Their main territory, which is in the Davis Housing Projects is from Grove Street (West) to Chamberlain Hills (North). They occupy an area of 0.54 square miles making them the largest Black gang territory in Davis. EAST SIDE BOUNTY HUNTERS GANG RELATED GRAFFITI

  12. I love criminal rp this the reason i play gta world but i do it realistically and we are not 24/7 doing crime, crime are commited when we PRESSED by the situation (Mostly due to economy) we not robbing people every night, but we do selling drugs all day. just think about (+) and (-) realistically about your crime that you commit in real life and its also the same in-game since its roleplay not Police and Robbers server.

  15. not gonna lie i get more of a realistic although not accurate feel from GTAW more so than LS-RP. On LS-RP, the playerbase turned toxic after a while, everybody was play to DM or play to win, never just play for fun. You had quality rpers, sure, but some of them dropped off the face of the earth and never got the chance to teach some of the newer players. With that shit going on at LS-RP right now? I'd say a lot of LS-RP players (the quality ones) will be GTAW bound.

  18. Nice and clean. I like it. A thing I would love to see more of, is more bag models. Both normal backpacks two strapped + more variations of sportsbags one strapped over the torso like the ones we have now, etc. I think if done right, your work would most likely get permanently on the server. At least I would hope for it! Keep up the great work mate!

  25. One night while out at the swap meet on Strawberry Avenue, Erica was approached by rumored sexual predators that were driving around the Chamberlain Hills / Strawberry area trying to prey on young girls. It never occurred to Erica that these 'sexual predators' were going to try to do the same to her. On the 1st of December, Erica was shot in Rollin 60s Neighborhood Crips territory by unknown males that were trying to kidnap her. She was on her way to a party from the store when she was approached by two unknown faces in a dark black SUV. Montrell Johnson came to Erica's aid by telling the males to leave her alone, and proceeded to try and walk Erica home. She persisted that she needed to attend a party in Chamberlain Hills and things took a turn for the worse.

  27. A lot of bars & clubs have cover fees or entrance fees when there's a DJ/band hired, so it's perfectly realistic & reasonable to keep them. It's possible to make money from the drinks sold, but not by much, certainly not enough to pay the staff. The entrance fee should definitely account for server crashes though.. I thought it used to let you back in without paying the fee again if you crashed or left/re-entered within a certain timeframe.. Maybe it could flag you to be able to enter/exit freely for the next 5 hours or so?
